REQUEST FOR EVIDENCES (RFE)
Recently, lot of people received USCIS notices of Request For Evidences (RFE), especially those filed their immigration petitions under the categories of EA and NIW. After initial screening, if USCIS deems the case is not immediately adjudicable, a request for additional evidences or other documentation will be issued. You have 12 weeks to respond and no extension is allowed. No interim benefits such as EAD or AP will be granted during this period. If you do not respond within the specified time limit, your case will be denied, and the denial can not be appealed.
Usually, the following situations will lead to a RFE. 1) Improperly filed petition, for an example, missing forms; 2). Your credentials are not strong enough to qualify for the category you are applying for; and 3). You have the qualifications, however, your case was poorly presented or organized.
RFE notice comes in standard format. It will ask you to answer the questions directly. However, if you answer those questions superficially, the result is usually denial. According to our data, more than 50 percent of RFEs ended in denial or withdrawal.
