Frequently Asked Questions

1. What are the benefits of applying an asylum? Can I work? Can I get a green card?
A: Asylum is an effective way to get U.S. permanent residency (green card). After 150 days of your asylum application, you can apply for work authorization for all people in your application even the application is not granted yet. If you are a J visa holder, a waiver of the two year home-country physical presence requirement will be granted. If you are in asylum processing or granted asylum, you are considered to be in legal status even you were out of status.

2. How long does it take for USCIS to process asylum application?
A:The time frame for processing asylum application varies very much, from several months to several years, on average 4 months.

3. Will an asylum application or a denial of asylum application have negative effects on other immigration petition?
A: No. You are strongly recommended to file employment-based or family-based immigration petition, if you somehow qualify, whether your asylum application is denied or is still in processing.

4. Will my home government learn about it if I apply for asylum?
A: USCIS will not inform foreign governments that one of their nationals has applied for asylum in the U.S.
